Terms and Conditions

DreamWeaver shall:

Provide a sailing yacht and competent crew beginning at 5 pm on day one and ending on day eight at 7 am unless otherwise arranged and confirmed in writing. In the event of a medical or family emergency, DreamWeaver reserves the right to substitute a crew member.
Provide all meals, snacks and beverages with the exception of 3 meals per week to be eaten ashore.
Bear all other costs directly associated with the sailing retreat, from the time Guests step off the plane until they board their return flight. This includes one taxi fare upon arrival and one upon departure.

Pay any expenses for additional services rendered at Guests' request, including liquor, diving or optional shore excursions, satellite communications, and personal purchases.
Indemnify and hold DreamWeaver, its insurers and crew harmless for any death or injury arising from swimming, the use of dinghies, snorkels, masks or other diving equipment, the abuse of drugs or consumption of alcohol. Guests shall be responsible for their own conduct, any resulting accidents, and for all costs, expenses or damages caused by their negligence, including but not limited to any damage caused by the guests or any other individual in their party.
Comply with all laws and regulations of the US or of any other government within the jurisdiction in which the vessel may be at the time.

DreamWeaver cannot be responsible or liable for loss, damage or theft of personal luggage and belongings. Please check with your insurance agent prior to departure to make sure you are adequately insured.
This Agreement shall be construed and interpreted in accordance with the laws of the State of South Dakota, with the exception of any admiralty or maritime claims which shall be construed under maritime and admiralty laws of the United States. The venue for any proceedings hereunder shall lie in Union County in the State of South Dakota.
Should either party to this Agreement violate any provision of this Agreement or in any proceedings to enforce the terms of this Agreement, the prevailing party shall be entitled to recover from the other all legal fees and costs that may be incurred, including any fees and costs associated with court ordered mediation and/or arbitration.
